1. Subject of the Agreement\nIn exchange for payment of the membership fee, Element Fitness provides the Member with sports and wellness services.<\/p>\n\n

2. Entire Agreement\nThis Service Agreement (\u201cTerms\u201d), together with the Privacy Policy published on the Element Fitness platform and, where applicable, consent to marketing communications, constitutes a unified and indivisible framework agreement. This framework agreement is valid indefinitely, regardless of the duration of any specific membership.<\/p>\n\n

3. Purchase of Membership\nEach time a Member pays for a selected membership, the agreement between the parties is considered concluded. No additional written document is required. All memberships are subject to these Terms.<\/p>\n\n

4. Amendments\nElement Fitness reserves the right to amend these Terms. Members will be notified at least 10 (ten) days in advance.\nIf a Member does not agree with the amendments, they must notify Element Fitness and request termination of services. Continued use of the membership constitutes acceptance of the amendments.<\/p>\n\n

5. Any disputes between the parties shall first be resolved through negotiations. If no agreement is reached, disputes shall be resolved in the courts of Georgia in accordance with Georgian law.<\/p>\n\n

6. Any matters not regulated by these Terms shall be governed by the applicable legislation of Georgia.<\/p>\n\n

7. Termination and Refund Policy<\/p>\n\n

\u2022 Memberships purchased in person are non-refundable.<\/p>\n\n

\u2022 For memberships purchased remotely, the Member may withdraw from the contract within 14 calendar days and request a refund.<\/p>\n\n

\u2022 If the membership has been used, the refund will be calculated proportionally based on the days used.<\/p>\n\n

\u2022 A refund request must be submitted in writing together with proof of payment.<\/p>\n\n

8. Health Condition\nThe Member is fully responsible for their health condition and confirms that they are physically fit for exercise.<\/p>\n\n

9. Rules and Schedule\nMembers must comply with the club\u2019s internal rules, regulations, and schedule. The administration reserves the right to make necessary changes.<\/p>\n\n

10. Transfer of Membership\nMemberships are non-transferable.<\/p>\n\n

11. Access Rules<\/p>\n\n

\u2022 Members must use their membership card\/sticker\/wristband and register entry and exit.<\/p>\n\n

\u2022 Sharing membership access is prohibited.<\/p>\n\n

\u2022 Violations may result in cancellation of the membership.<\/p>\n\n

12. Lockers<\/p>\n\n

\u2022 Items left overnight may be removed by the club.<\/p>\n\n

\u2022 The club is not responsible for lost or damaged items.<\/p>\n\n

Storage of illegal items is strictly prohibited.<\/p>\n\n

13. Valuables\nThe club is not responsible for the loss, damage, or theft of valuables.<\/p>\n\n

14. Children and Minors<\/p>\n\n

Registration of minors requires parental or legal guardian consent.<\/p>\n\n

Individuals under 16 may exercise only under the supervision of a personal trainer.<\/p>\n\n

15. Group Classes<\/p>\n\n

Advance booking is required.<\/p>\n\n

Late arrival may result in denied entry.<\/p>\n\n

Participants must follow group class rules.<\/p>\n\n

16. Membership Suspension<\/p>\n\n

1-month membership \u2013 1 suspension (up to 5 days)<\/p>\n\n

3-month membership \u2013 3 suspensions (up to 15 days total)<\/p>\n\n

6-month membership \u2013 4 suspensions (up to 20 days total)<\/p>\n\n

12-month membership \u2013 unlimited suspensions (up to 35 days total)<\/p>\n\n

17. Code of Conduct<\/p>\n\n

Members must respect the personal space of others.<\/p>\n\n

Aggressive, offensive, dangerous behavior or being under the influence of alcohol or substances is prohibited.<\/p>\n\n

Violations may result in termination of membership and\/or involvement of law enforcement.<\/p>\n\n

18. Dress Code<\/p>\n\n

Appropriate sportswear and footwear are required.<\/p>\n\n

Exercising in outerwear is prohibited.<\/p>\n\n

Exercising without a shirt is not permitted.<\/p>\n\n

19. Photo and Video Recording\nPhoto and video recording is prohibited in locker rooms and other private areas.<\/p>\n\n

20. External Trainers\nTraining sessions conducted by non-employed trainers require prior administrative approval.<\/p>\n\n

21. Video Surveillance\nSecurity cameras operate within the club. Recordings are stored for 14 calendar days.<\/p>\n\n

22. Membership Termination\nThe club may terminate or cancel a membership in case of violation of these Terms.<\/p>\n\n

23. Pets\nPets are not permitted inside the club premises.<\/p>\n\n

24.
